€ 140,000 penalty for not detecting malformations in a fetus

A family from Almeria will receive 140,000 euros as compensation after the complaint of negligence in a private clinic.

The events happened in 2006 when C. B. S., a 40-year-old pregnant woman went to a private clinic to perform various controls.

Specifically, two different physicians performed ultrasound scans during weeks 12, 16, 20, 25, 29, 34 and 38 of their pregnancy and at no time were they informed of any deviation from normality.

The baby was born with malformations that affect both arms. The couple claimed that “There was no prenatal diagnosis of this malformation. That is to say, to the usurpation of the right of parents to decide whether or not to continue with the pregnancy, the enormous psychological impact is added after childbirth ”explained the lawyer Ignacio Martínez García.

After more than a year of negotiations, the parties have reached the agreement mentioned without the existence of a lawsuit.

I honestly fail to understand how, in nothing less than seven ultrasounds during a pregnancy (for the three performed by social security protocol) and taking into account that currently the definition of ultrasound is much better than years ago, neither of the two doctors will find any problem.
